Terms of Service

1. Scope
These terms apply to all orders placed through goodsmile-europe.com. The storefront is operated by Figuya GmbH under licence from Good Smile Company; "Good Smile Europe" is the brand name under which Figuya GmbH trades for this storefront. By placing an order, you enter into a contract with Figuya GmbH and agree to these terms. We contract with both consumers and businesses; conflicting terms from the buyer are not accepted unless expressly agreed in writing.

3. Contract Language and Storage
The contract language is English. We do not store the contract text beyond the order confirmation. You can print your order summary before completing the purchase. Order data and these terms are sent to you by email.
4. Orders and Contract Conclusion
Product listings on our site are invitations to make an offer, not binding offers. By clicking "Buy" or "Place Order", you submit a binding offer. The contract is concluded when we confirm your order by email or when the goods are dispatched, whichever comes first.
5. Right of Withdrawal
Consumers are entitled to a 14-day right of withdrawal. Full details are available on our returns page.
6. Prices and Shipping
All prices include VAT. Shipping costs are shown during checkout and on our shipping page.
7. Delivery
We ship via DHL to all countries listed on our shipping page. Pre-order and back-order items ship when available; estimated dates are shown on the product page.
8. Payment Methods
We accept PayPal, credit card, direct debit, bank transfer, and Klarna. Available methods are shown at checkout. The contract is concluded at the time specific to each payment method, as indicated during the order process.
9. Retention of Title
Goods remain our property until full payment is received.
10. Transport Damage
If your delivery arrives damaged, please report it to the carrier and contact us with photos. For business customers, risk passes upon handover to the carrier; inspection obligations per § 377 HGB apply.
11. Warranty
Statutory warranty rights apply. For used goods sold to consumers, the limitation period is one year. For business customers, the limitation period is one year from risk transfer.
12. Liability
We are fully liable for damages arising from injury to life, body, or health, and for damages caused by intent or gross negligence. For slight negligence in breach of essential contractual obligations, liability is limited to foreseeable, typical damage. Liability under the Product Liability Act remains unaffected.
13. Governing Law and Jurisdiction
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For business customers, the place of jurisdiction is Berlin. For consumers, statutory provisions apply.
14. Severability
If any provision of these terms is invalid, the remaining provisions remain in effect.
15. Dispute Resolution
The European Commission provides an online dispute resolution platform at ec.europa.eu/consumers/odr. We are not obligated and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
